Subpoena
A subpoena commanding a MDHHS employee’s appearance for testimony at a deposition or court proceeding must be served upon that employee. Please submit such subpoenas to the office where the employee works. A map of the county MDHHS offices is available on our website.
Subpoenas for Records
- Subpoenas for Child Protective Services (CPS) Records: Send your subpoena along with an executed authorization via postal mail to the MDHHS county office where the CPS case occurred; A map of the county MDHHS offices is available on our website.
- Subpoenas for Other Records: Email your subpoena along with an executed authorization form to MDHHS-Subpoena@michigan.gov. You may also post your subpoena and authorization to Michigan Department of Health and Human Services, Office of Legal Affairs, Suite 207, PO Box 30037, Lansing, MI 48909. Submitting your subpoena via email generally reduces processing time.
Subpoena Considerations
When considering the use of a subpoena, please note the following:
- Michigan and Federal laws designate many, if not most, MDHHS records confidential and, therefore, not subject to discovery via subpoena without additional supporting documentation, such as a valid authorization form. Familiarize yourself with the applicable laws to ensure prompt processing of your subpoena.
- Michigan Court Rule (MCR) 2.305(B) requires that a subpoena requesting copies of MDHHS records must be served on MDHHS at least 14 days prior to the subpoena’s deadline.
- It is very helpful if you include who the attorney requesting the MDHHS records represents.
